Only the woman has the freedom to decide whether to continue the pregnancy or not. The High Court allowed a 33-week pregnant married woman to have an abortion, saying the medical board did not have that right and the court could not override her right.

On 20 January Gautam Patel and Justice. S. G. Digge’s bench allowed the woman to have an abortion. However, a copy of the order was made available on Monday. The medical board expressed the opinion through the report that although there are many abnormalities in the fetus, the woman cannot be allowed to have an abortion as her delivery period is approaching. After the sonography of the concerned woman, it was revealed that there were many abnormalities in the fetus. After sonography showed that the baby would be physically handicapped and mentally disabled, the woman approached the High Court seeking permission for the abortion.

It doesn’t matter how many months a woman is pregnant as there are many sarcomas in the fetus. The petitioner has decided. This is not an easy decision to make. However, that decision is hers and she has to decide alone. The court said that the right of choice lies with the petitioner. Refusal to terminate a pregnancy on grounds of delay does not condemn the fetus to a life less than expected. That would condemn the mother to a future that would rob her of the positive qualities of parenting, the court observed.

…traumatic parenting
Accepting the advice of the medical board will deprive the child of a quality life. Similarly, the petitioner and her husband will experience unhappy and very painful parenting. The court said that it cannot even imagine how it will affect them and their families.

Don’t blindly apply the law
1. Women’s rights, freedom of decision making and reproduction will be denied. The mother knows that the baby is unlikely to be born as a normal healthy baby.
2. Rights of women cannot be compromised by blind application of law. The high court allowed the woman to have an abortion, saying that the medical board could not take into account the social and economic status of the couple.
