HC criticizes government’s indifference in filing appeals

A bench of the High Court on the issue of late filing of the letters patent appeal filed by the Fee Revision Committee against the order of a single judge approving the fee structure of Shreyas School in Ambawadi area of the city, criticized with grave displeasure the belated attitude of the committee. The High Court directed the committee to come up with any policy for filing appeals and adjourned the case for further hearing in the coming days.
The details of this case are that the fee structure of Shreyas School in Ambawadi area of the city for 2020-2021 was decided by the Fee Determination Committee at that time. Against this order of the single judge, the Fee Revision Committee was supposed to file the Letters Patent Appeal before the High Court bench in 2022, but the appeal was filed by the committee till 2023, and the High Court criticized the committee’s decision to show such a delayed attitude. Ironically, the High Court said to the committee that you had to file an appeal in 2022 and you are still filing an appeal in 2023…? Did you really want to file an appeal or filed for vacating..? Filing an appeal will not go according to the whims of your officials. If such belated appeal is filed by you, the court will not hesitate to penalize you. Further, the High Court also directed the committee to present any policy of the government on filing appeals in such cases in the next term. The High Court also noted that the appeal was actually to be filed by the Fee Revision Committee but when the appeal was filed by the Education Department, the High Court also took serious note of this matter. Meanwhile, the High Court directed the Fee Revision Committee to present any policy of filing appeals and also urged to present the documents regarding the stage wise decision taken by the committee so far.
