In Vadodara, the accused who did not repay the car purchase loan was jailed for two years

The court ordered the accused who did not repay the car purchase loan amount to simple imprisonment for two years, to pay 2.98 lakhs as compensation within 30 days and to issue a non-bailable warrant to the accused who did not appear before the court and sent him for execution.
During the year 2019, Bhavin Jadav, authorized of Kotak Mahindra Prime Limited, filed a complaint that the accused Ashwin Khodbhai Dalsania (Resident of Rajkot) had passed a loan of 2.98 lakhs through a written agreement after applying for a car loan. Then he did not respond to the notice of non-payment of legal dues. During the hearing of the case, lawyer Y.I. Rana for the prosecution and lawyer KK Patel for the accused made arguments. Seventh Additional Chief Judicial Magistrate Deepak Hasmukhbhai Khambati, after examining the arguments and evidence of both sides, noted that such cases are increasing day by day in the current times. Giving a check is an attempt to escape from one’s liability or debt. So this type of provision has been made in this act to prevent misuse of such negotiable instruments. And the accused should be punished in such a way that he realizes his act. The court is of the opinion that it would be reasonable and just if the court orders only compensation instead of imposing penalty on the accused.
