Nearly 13 and a half years after his death, Jail IG Ramanuj Sharma has got justice from the Rajasthan High Court. The court of Justice Anoop Dhandh, accepting the petition of late Ramanuj Sharma, canceled the charge sheet and punishment given to him a day before his retirement.
The court has ordered the government to return the pension amount deducted as punishment to the late IG to his heirs with 9 percent interest. Ramanuj Sharma had filed an appeal against the government order in 1999. He died there on 10 April 2010.
Charge sheet handed over a day before retirement
Late Ramanuj Sharma retired from the post of Jail IG on June 30, 1991. A day before this, a chargesheet was handed over to him in a 14-year-old case of 1977 and disciplinary action was initiated against him.
According to the charge sheet, two jail guards were found guilty by the Magistrate Court in 1976 and given the benefit of probation. This order was also reinstated by the DJ Court. During this time both the guards were under suspension.
The applicant had ended the suspension of both and sent the matter to the competent authority to take a decision regarding their dismissal from the job. The government said that as Jail IG, the applicant had committed wrong by misusing his powers and ending the suspension. After hearing the disciplinary proceedings against the applicant for eight years, in 1999 he was punished by deducting five percent of the amount from his pension for two years.

Said in the appeal – the entire proceeding is malicious and illegal
Advocate Arihant Samdaria, who appeared on behalf of late Ramanujan and his heirs, said that in 1977 itself, the applicant had sent the matter to the competent authority to take a decision on the dismissal of the two guards. The entire matter was in the knowledge of the competent authorities since then. If any action was actually to be taken against both the guards, then why was a minor punishment like withholding two increments of both of them, twenty years later in 1997, given.
In such a situation, when no action like dismissal was taken against both the guards, then complete action was taken including giving charge sheet to late Ramanuj Sharma a day before his retirement, hearing the case for eight years and ordering the punishment of withholding five percent of pension for two years. Is malicious and illegal.

Fought legal battle for father’s honor
On the decision in favor of her late father, almost 32 years after the appeal was filed, his elder daughter Ritu Sharma said that we are happy that the truth has prevailed. Our father was implicated due to political malice. He was deliberately given a charge sheet in a 14 year old case a day before his retirement.
When nothing was found even after 8 years of hearing, he was considered partially guilty and punished. He said that after our father’s death, our mother Chandrakanta Sharma fought this case. But after mother’s death, we four sisters and our brother decided that we would fight this case further. Because for us it was a matter of honoring our father.
He also thanked retired Justice SK Keshot for his cooperation in the case. He said that when SK Keshot was a lawyer, the case was filed under his guidance only. Later he was appointed judge in Gujarat High Court. But after retiring from the post of judge, he again helped us a lot in our case.
