Unrecognized CBSE schools in Tamilnadu… Madras High Court major order
The Madras High Court has been informed by the Tamil Nadu School Education Department that action has been initiated against a private school which falsely advertises that it is CBSE accredited and conducts admissions.
In this regard, Motilal, a resident of Periya Kanchipuram Koneri Kuppam area, had filed a petition in the Madras High Court. After the Kumbakonam school fire incident in 2001 in which 96 children lost their lives, the Tamil Nadu government issued an ordinance in 2006 to lay down various safety procedures for private schools to gain recognition based on the rules laid down by the commission headed by Justice Sampath.
He pointed out that the Supreme Court, which heard the case related to the same incident, had ordered security procedures and the Right to Education Act states that schools should not be allowed to operate without government approval.
He said in the petition that conditions such as obtaining license for school buildings and obtaining building stability certificate have also been prescribed in this Act.
However, he has alleged in the petition that a school called ‘Vitha Public School’ is functioning in Kanchipuram with rooms as small as a mansion and without any recognition or approval and is conducting admissions by falsely advertising that it is CBSE approved.
In the petition, he has requested to order the Tamil Nadu School Education Department to take action against this private school, which is admitting students through false advertisements without suitable building facilities.

When the case came up for hearing before the in-charge Chief Justice Raja and Justice Manjula, the school education department informed that a notice has been sent against the concerned school, action has been initiated and the petitioner’s application will be considered.
The judges who recorded this, considered the application filed by the petitioner in this regard and ordered to issue an order. The judges have also ordered the government to take steps to transfer the students studying in the concerned school to recognized schools.
